1. Acceptance of Terms

Welcome to WishBOT ("we," "our," or "us"), operated by Letwish Network Enterprise, a company incorporated in Malaysia. These Terms of Service ("Terms") constitute a binding agreement between you and WishBOT under Malaysian contract law.

1.1 Agreement Formation

By accessing or using WishBOT, you confirm that:

• You have the legal capacity to enter into this agreement under Malaysian law
• You provide free and voluntary consent to these Terms
• You understand the consideration for lawful purposes
• This agreement is intended to be legally binding

1.2 Age and Eligibility

You must be at least 18 years old or have reached the age of majority in Malaysia to use our services. By using WishBOT, you represent that you meet these requirements.

2. Description of Service

WishBOT is an AI-powered platform that enables businesses to create professional video advertisements through conversational interactions. Our Service includes:

• AI-driven video content generation
• Customizable video templates and assets
• Business-focused conversation flows
• Video editing and export capabilities
• Analytics and performance tracking

3. User Accounts and Registration

3.1 Account Creation

To use our Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Eligibility

You must be at least 18 years old and have the legal capacity to enter into this agreement. By using our Service, you represent and warrant that you meet these requirements.

3.3 Account Security

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Payment Terms

4.1 Available Plans

WishBOT offers the following subscription plans to Malaysian users:

• Free Plan: 16 credits included, suitable for trial purposes
• Creator Plan: 60 credits monthly, access to all video durations (8s-64s)
• Pro Plan: Enhanced features with higher credit allowances

4.2 Credit-Based System

Our service operates on a transparent credit system where 1 credit equals 1 second of video generation. All pricing is displayed in Malaysian Ringgit (MYR) and US Dollars (USD) for your convenience.

4.3 Payment Processing

• All payments are processed securely through Stripe, a PCI DSS compliant payment processor
• Payment information is not stored on WishBOT servers
• Subscription fees are subject to applicable Malaysian taxes (SST) if required
• Currency conversion rates are determined by your payment provider

4.4 Malaysian Consumer Protection

In accordance with the Consumer Protection Act 1999 (Malaysia):

• Clear disclosure of all fees and charges
• 30-day advance notice for any price changes
• Right to cancel subscriptions with immediate effect for the next billing cycle
• Dispute resolution through the Tribunal for Consumer Claims Malaysia if applicable

4.5 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. Refunds may be available in accordance with Malaysian consumer protection laws.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use WishBOT solely for creating legitimate business video content in compliance with applicable laws and these Terms.

5.2 Prohibited Uses

You agree not to use our Service for:

• Creating misleading, fraudulent, or deceptive content
• Generating content that violates intellectual property rights
• Creating offensive, discriminatory, or harmful material
• Circumventing usage limits or security measures
• Reverse engineering or competing with our Service
• Violating any applicable laws or regulations

6. Intellectual Property Rights

6.1 Your Content

You retain ownership of any content you provide to our Service. By using WishBOT, you grant us a limited license to process your content for the purpose of providing our Service.

6.2 Generated Content

You own the videos and content generated through our Service, subject to our underlying intellectual property rights in the platform and technology.

6.3 Our Intellectual Property

WishBOT, including our AI technology, software, and branding, is protected by intellectual property laws and remains our exclusive property.

7. Artificial Intelligence and Data Processing

7.1 AI Video Generation Technology

WishBOT utilizes artificial intelligence technology, including KIE AI Veo 3.1 and Google Gemini, to generate personalized video content based on your business information and preferences.

7.2 AI Training and Model Improvement

In compliance with Malaysian PDPA principles:

• We use only anonymized and aggregated usage patterns for AI model improvement
• Personal identifying information is removed before any data is used for training purposes
• You may opt out of AI training by contacting our Data Protection Officer
• All AI processing follows the PDPA security and retention principles

7.3 Intellectual Property in AI-Generated Content

Under Malaysian intellectual property law:

• You retain full ownership of videos generated through WishBOT
• AI-generated content becomes your intellectual property upon creation
• WishBOT retains ownership of the underlying AI technology and platform
• You grant WishBOT a license to process your input data for service provision

7.4 Third-Party AI Services

We engage reputable third-party AI service providers under strict data processing agreements that meet Malaysian PDPA standards.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference and complies with the Malaysian Personal Data Protection Act 2010.

9. Service Availability and Modifications

9.1 Service Availability

We strive to provide reliable service but cannot guarantee 100% uptime. We may experience downtime for maintenance, updates, or unforeseen circumstances.

9.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time with reasonable notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHBOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OF OUR SERVICE.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless WishBOT and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases, and we may delete your account and associated data.

13. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

12.2 Dispute Resolution

Any disputes arising from or relating to these Terms shall be resolved through the following process:

• Negotiation: Parties shall first attempt to resolve disputes through good faith negotiation within 30 days
• Mediation: If negotiation fails, disputes shall be referred to mediation under the KLRCA Mediation Rules
• Arbitration: If mediation is unsuccessful, disputes shall be resolved by binding arbitration administered by the Kuala Lumpur Regional Centre for Arbitration (KLRCA) under the KLRCA Arbitration Rules

12.3 Jurisdiction

The courts of Malaysia shall have exclusive jurisdiction over any legal proceedings not subject to arbitration, and the seat of arbitration shall be Kuala Lumpur, Malaysia.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through our Service. Continued use after changes constitutes acceptance of the new Terms.
